What to Do If You Are Pulled Over for Driving Under the Influence

January 03, 2018

By van der Veen, Hartshorn, Levin & Lindheim

Being pulled over by an officer for possible drunk driving is a tense situation. It is easier for a person’s nerves to get the best of them. This nervous energy could be misinterpreted by the officer as an indicator that you have been drinking and driving. If you are facing driving under the influence (DUI) or driving while intoxicated (DWI) charges, hire a Philadelphia DUI attorney immediately. Do not make the mistake of speaking to an officer without an attorney present. You may incriminate yourself if you speak without consulting an attorney. Let us do the talking for you.

What to Do If You Are Pulled Over

If you are pulled over for suspected DUI/DWI charges, make sure you remain as calm and helpful as possible. The following helpful tips are useful:

  1. Pull over in a safe location.

The officer is observing your movements from the moment he decides to pull you over for driving under the influence (DUI). Be aware that he is monitoring your every move to document in his police report. This means how you pull over can say a lot. Make sure you are cautious and abide all traffic laws.

  1. Do not move suddenly.

An officer’s first concern is protecting himself. Any sudden or abrupt movements may be interrupted as a threat. Keep your hands on the steering wheel as the officer approaches the vehicle from behind. Do not turn around because the officer is intentionally coming from behind so that he has a clear view if you decide to turn around to shoot or attack them. Face forward until the officer reaches the vehicle to speak with you.

  1. Be courteous.

It is always a good idea to remain polite when addressing an officer. It is common courtesy and being rude will not do anything to help your case and the officer is more likely to write a less than favorable police report. Be friendly and responsive to the officer’s requests. Failing to get out of the vehicle when asked can lead to a charge for resisting arrest.

  1. Tell the truth but politely decline to answer any incriminating questions.

You are required to provide the officer with your name, license, insurance information, and registration. The officer is counting on your nerves and anxiety to incriminate you. This is a stressful situation and your reaction may come across as damaging even if you have not committed any crime. But if the officer asks you any question that could lead to you incriminating yourself, such as whether you have been drinking, you can kindly respond that you are advised not to answer any questions. At this point, you may be placed under arrest but this is a better outcome than giving any incriminating answers.
