

Attorney David Devine of van der Veen, Hartshorn, Levin & Lindheim secured a $175,000 jury verdict for a 34-year-old mother of three in a limited tort car accident case. The June 21, 2021, collision at North 17th & Poplar Street occurred when the defendant ran a stop sign, striking plaintiff's car. Despite the defense emphasizing plaintiff's prior accidents and similar injuries, lead counsel David Devine and paralegal Henry Leopold established that this crash caused the plaintiff significant impairment, given that she underwent four months of chiropractic treatment and transitioned to a less physically demanding job due to her injuries.
After testimony from the plaintiff and her daughter, the jury found the defendant fully liable, determining that plaintiff suffered a serious impairment of a critical bodily function. Overcoming the limited tort threshold, the jury awarded $175,000 for pain and suffering.
