Eight-Year Sentence Reduced to Non-Custodial Sentence, Allowing Former Law Enforcement Officer to Move on With His Life

October 20, 2024

By van der Veen, Hartshorn, Levin & Lindheim

We are excited to report that a client of ours who is a former law enforcement officer had his proposed plea-deal reduced from eight years of imprisonment to a non-custodial sentence. This result gives him the opportunity to rebuild his life, care for his family, and continue to contribute positively to society. Richard Coble, the lead attorney on the case, was instrumental in achieving this outcome.

When our client first came to us, he was burdened by the possibility of spending the next eight years of his life behind bars for various offenses, an aberrant outlier for the man. It was a daunting reality for someone who had spent much of his career protecting and serving his community. However, once Richard took charge of the case, he meticulously worked through complex procedural and discovery issues with the State prosecutors. His diligence and deep understanding of the legal system allowed him to negotiate a favorable non-custodial sentence for our client.

This result is not only a legal victory but a personal triumph for our client. As a former officer, he has devoted his life to making a difference and serving those around him. While he acknowledges the mistakes that led to these charges, we are grateful that the court and prosecutor’s office recognized his past service and potential for future positive contributions. Now, he can continue to be a dedicated husband, father, and member of the community.

Richard Coble reflected on the outcome, saying, "This is why we do what we do at our firm. It’s all about helping people. I'm incredibly proud of this result, as it gives our client a second chance to live the life he’s worked so hard for and make amends for the past. He has shown a commitment to moving forward, and I am confident he will continue to contribute positively to society."

This case highlights the importance of having dedicated legal representation to ensure fair treatment in the justice system. We are proud to have played a role in helping our client move forward with his life.

Criminal Record Avoided with Diversionary Program

When people make mistakes and break the law, a criminal record is not always the best outcome for society. In many cases, giving individuals the opportunity to reform and learn from their actions can lead to better long-term results.

A recent client of ours, who faced firearm charges along with other offenses, came to us hoping for a fresh start. He was committed to making a change and abiding by the law going forward. With a strong desire to rebuild his life, he sought a way to avoid the lasting consequences of a criminal record.

Richard Coble, a key member head of our firm’s criminal defense team, stepped in to negotiate with the prosecution. He successfully advocated for our client’s placement into a diversionary program, an alternative path designed to keep him from carrying the burden of a criminal conviction. This program not only shields him from a permanent record but also provides education on the gravity of gun safety and the serious responsibilities that come with handling firearms.

“Everyone deserves a second chance, especially when they show genuine commitment to change. This program allows individuals to learn from their mistakes without a permanent mark on their future. This is what true justice looks like,” Richard Coble explained.

Once the program is completed, the client's case is scheduled to be withdrawn and fully expunged, preventing any future stigma, embarrassment, or legal obstacles.
